This Privacy Policy explains how AquaFarm Software LLC (“AquaFarm,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit aquafarm.com (the “Site”), purchase or subscribe to an AquaFarm license, contact us, or install and activate the AquaFarm software (the “Software”). By using the Site or the Software, you agree to the practices described in this Privacy Policy. Use of the Software is also governed by the AquaFarm End User License Agreement.
1. Information We Collect
Information you provide to us.
- Contact and support requests. When you send us a message through a form on the Site or by email, we collect your name, email address, organization, and anything else you choose to include, such as a description of your project or question.
- Purchases and subscriptions. When you buy or start a subscription, you provide your name, email address, billing address, and payment card details, together with the license type and quantity selected. Payment card details are entered directly into the checkout pages of our payment processor, Stripe, and are handled by Stripe. We do not receive or store your full card number.
- Quote requests. When you request a Commercial license quote, we collect the information you include in your email, such as your name, job title, organization, country, contact details, and intended use.
Information collected when you use the Software. The Software does not transmit your Project files, simulation results, or other content you create. These remain on your computer. When a license is activated on a computer, when an activation is released, and when a subscription license is checked for renewal, the Software sends the license key together with a hardware-derived machine identifier to our license management service. This is used solely to activate the license on that computer, count activations against the number purchased, and confirm renewals. The machine identifier does not identify you personally. The Software does not otherwise contact us during normal operation.
Information collected automatically on the Site. Like most websites, our web hosting provider automatically records standard server log information when you visit, such as your IP address, browser type, the pages you request, the referring page, and the date and time of the request. The Site does not use analytics, advertising, or tracking cookies, and does not use third-party tracking tools. Stripe may use cookies and similar technologies on its own checkout and customer portal pages, including for fraud prevention, as described in Stripe’s Privacy Policy.
2. How We Use Information
We use personal information to:
- process purchases and subscriptions, issue and deliver license keys, and send download and activation instructions;
- send transactional messages about your license and subscription, such as trial-ending reminders, renewal notices, receipts, and notices of failed payments;
- activate, validate, and renew licenses, and prevent unauthorized use of the Software;
- respond to your questions, support requests, and quote requests;
- maintain the security and operation of the Site, the Software, and our licensing systems, and detect and prevent fraud; and
- comply with legal, tax, and accounting obligations, and enforce our agreements, including the EULA.
We do not send marketing email unless you have asked to receive it, and any marketing email will include a way to unsubscribe.
3. How We Share Information
We do not sell or rent your personal information, and we do not share it for targeted advertising. We share personal information only as follows:
- Service providers. We use trusted providers who process information on our behalf and only for the purposes described in this Policy. These include Stripe (payment processing, subscription billing, and billing emails), Soraco Technologies (hosting of our license management service and delivery of license key emails), our website hosting provider, and our email and form-handling providers.
- Legal requirements. We may disclose information if required by law, subpoena, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
- Business transfers. If AquaFarm Software LLC is involved in a merger, acquisition, financing, or sale of all or part of its assets, personal information may be transferred as part of that transaction, subject to this Privacy Policy.
- With your consent. We may share information for any other purpose with your consent.
4. Data Retention
We keep personal information for as long as needed to provide licenses and support, to maintain records of license keys and activations for the life of your license, and to meet legal, tax, and accounting requirements. Correspondence is kept for as long as it is reasonably needed to respond to you and keep a record of our dealings. When information is no longer needed, we delete it or de-identify it.
5. Security
We take reasonable administrative, technical, and physical measures to protect personal information. Payments are processed by Stripe, which is certified to PCI DSS Level 1. License communications between the Software and our license management service are encrypted in transit. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
6. Your Choices and Rights
- Access, correction, and deletion. You may ask us for a copy of the personal information we hold about you, or ask us to correct or delete it, by contacting us as described below. We may need to keep some information, such as records of purchases and licenses, where the law requires it or where it is needed to maintain a license you still hold.
- Subscriptions and payment details. You can update your payment card or cancel a subscription at any time through the manage-subscription link in your subscription emails from Stripe.
- Transactional email. Messages about your license and subscription are part of the service and cannot be turned off while your license is active.
- U.S. state privacy rights. Depending on where you live, you may have additional rights under state law, such as the right to know what personal information we collect and how we use it, and to request deletion or correction. We do not sell personal information or share it for cross-context behavioral advertising. We will not discriminate against you for exercising any of these rights.
- Visitors outside the United States. AquaFarm Software LLC is based in the United States, and your information will be processed in the United States, where data protection laws may differ from those in your country. If you are in the European Economic Area, the United Kingdom, or Switzerland, we process your personal information to perform our contract with you (for example, to deliver and maintain your license), for our legitimate interests (for example, to secure our systems and prevent unauthorized use), and to comply with legal obligations. You may have the right to access, correct, delete, restrict, or object to the processing of your personal information, to data portability, and to lodge a complaint with your local data protection authority.
To exercise any of these rights, contact us as described in Section 10. We may need to verify your identity before responding.
7. Children’s Privacy
The Site and the Software are intended for professional, academic, and adult users. They are not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us and we will delete it.
8. Links to Other Websites
The Site contains links to websites and services operated by others, including Stripe’s checkout and customer portal pages. Their privacy practices are governed by their own policies, and we are not responsible for them. We encourage you to read the privacy policy of any site you visit.
9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and change the effective date above. If we make material changes, we will take reasonable steps to let you know, such as by email to license holders.
